Transfer placer or quartz claims

You can transfer placer and quartz claims to someone else. This means they’ll own the claims. You must use a separate form for each person you are transferring claims to. A separate form will be required for the different types of mineral tenure.

Prepare your transfer form

To submit a transfer form, you’ll need a:

  • list of claims to transfer; and
  • company seal or statutory declaration, if applicable.

List of claims to transfer

You need to include the grant numbers and names of the claims you want to transfer on the form.

If you want to attach a list of claims with the transfer form, label the list of claims “Schedule A”. Have the person transferring the claims sign and date each page you attach. You’ll need to reference it in the form.

Transfer on behalf of a company

To transfer claims on behalf of a company, you need to include the following in your form:

If you affix the company seal to the transfer form, you do not need to have the transfer witnessed, nor the affidavit of witness and a notary public.

If you do not affix a company seal, you must:

  • have a witness watch you complete the form;
  • have the witness and notary public complete the affidavit of witness on the transfer form; and
  • have the person transferring the claims complete the statutory declaration and have it notarized.

Corporations must be registered with Yukon's’ Corporate Affairs if they want to:

  • hold claims; or
  • do other business related to claims.

Transfer from a person

If you’re an individual transferring claims, you do not need to include a statutory declaration for the transfer of claims form. You only need the signatures of a witness on the affidavit of witness included in the transfer form to be completed by the witness and a notary public.

Submit your transfer form

  1. Download and complete the applicable form.
    • Quartz claim transfer form.
    • Placer claim transfer form.
    • List all the claims you want to transfer on the form, or to attach a list of claims, write “Schedule A” in the space allotted for the claim numbers.
    • The form must be completed in front of a witness.
    • The witness’s signature must be notarized by a notary public. If you live in a jurisdiction outside of the Yukon, the witness must still complete the witness’s affidavit in full.
    • If you live in a jurisdiction that uses a different form for an affidavit of witness, both forms must be completed and submitted.
    • All signatures on the form must be originals, digital signatures will not be accepted.
  2. Attach all applicable documents to the form:
    • List of claims (i.e.: Schedule A); and
    • company seal or statutory declaration.
  3. Submit your transfer form in person, by email or mail to the mining recorder’s office in the same mining district your claims are located in.
    • If submitting by email, the original signed form will need to be received in office.
  4. Pay the fees by cash, cheque, debit or credit.
    • For quartz claims:
      • $2.50 for the first claim; and
      • $1 for every additional claim.
    • For placer claims:
      • $2.00 for the first claim; and
      • $1 for every claim after.

What happens next?

We will mail a copy of the transfer form to the new claim holder once the transfer is recorded and processed.

Paying financial security

The new owner of the claims may need to pay security if the claims:

  • overlap with an existing surface disposition; or
  • are on Category B Settlement Land.

The district mining recorder will determine if the new owner needs to pay financial security and will notify the applicant. Security payments can be arranged through the mining recorder’s office.

Notification or mining land use approval 

If a Class 1 notification or mining land use approval is in place for the claims, the previous owner of the claims may also have to assign the Class 1 notification or mining land use approval associated with the claims to the new owner. The new owner of the lease will need to adhere to all the requirements of the permit.
