The new Condominium Act, 2015 provides that public authorities can develop leasehold condominium housing on lands that they own, including Category A and B Settlement Land and fee simple Settlement Land, if that land is registered in the Land Titles Office.
A “public authority” is a body that has the ability to approve certain aspects of condominium development. It also has the ability to enter into an agreement to allow for the development of a leasehold condominium on land that they own and that is registered in the Land Titles Office.
