We encourage employees and employers to resolve their issues directly if possible. If not, contact us for information about filing a wage complaint under the Employment Standards Act.

Who can submit a wage complaint?

If there’s a dispute over wages, either the employer or employee can submit a wage complaint. A third party can also file on someone’s behalf.

When can I submit a wage complaint?

You must file your complaint within 6 months of the date the wages were due.

Why submit a wage complaint?

Submit a wage complaint if you believe you are owed:

  • regular wages;
  • overtime pay;
  • vacation pay;
  • general holiday pay;
  • termination pay;
  • unauthorized deductions;
  • reporting pay;
  • minimum wage (or fair wage schedule);
  • entitlement to job protected leave; or
  • entitlement to other compensation under the employment contract

We’ll investigate the last 12 months of employment records and issue a certificate for any wages owed.

You can keep your complaint confidential to protect your relationship with your employer.
